24 October 2025 | ZERO5G.com |Proposed legislation, H.R. 5147, the “WIRELESS Leadership Act” to amend the Communications Act of 1934, acknowledges the actuality of  ENVIRONMENTAL EFFECTS of RADIOFREQUENCY EMISSIONS. The bill aims to accelerate wireless radiation deployment while attempting to prevent State and local governments from exercising necessary regulatory control over irradiating infrastructures.

‘‘(vi) ENVIRONMENTAL EFFECTS OF RADIO FREQUENCY EMISSIONS.—No State or local government or instrumentality thereof may regulate the operation, placement, construction, or modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities or structures comply with the Commission’s regulations concerning such emissions.’’

H.R. 5147 exceeds the Telecommunications Act (TCA) by providing for regulatory control of the operation of wireless facilities. Regulation of the operations of Wireless Telecommunications Facilities (WTFs) was never preempted from local zoning authority under the TCA. As Congress continues to waging wireless warfare, the fact remains that electromagnetic radiation is defined as pollution and is uninsurable.
